Terms of Use

By using the Snockles.com web site (the "Service") you agree to the following terms and conditions (the "Terms of Use"). Snockles.com ("Site") also refers to all or any of its group-sites (e.g. snockles.co.uk). You should also go through our Privacy Policy at www.snockles.com/privacy. Usage of the Service is also governed by the Privacy Policy, which is integrated into these Terms of Use by this reference. In the event of variation between these Terms of Use and the Privacy Policy, the Terms of Use shall prevail.

General Terms

1. You must be at least 13 years old to use this site.
2. The responsibility for keeping your password secure is yours only.
3. You shall be responsible for any type of activity that occurs under your user name.
4. You must not use the Snockles.com service for any unauthorized or illegal purpose. All users agree to obey all local laws concerning acceptable content and online conduct.
5. You must not abuse, threaten, harass, intimidate or impersonate other Snockles users.
6. You are solely responsible for your conduct and any information, data, screen names, text, profiles, photos, graphics, audio and video clips, links ("Content") that you submit, post, and exhibit on the Snockles.com service.
7. You must not create/ submit unsolicited email to any Snockles users ("Spam").
8. You must not adapt, modify or hack Snockles.com or create/ alter another website so as to misleadingly imply that it is associated with Snockles.com.
9. You must not, while using Snockles, violate any laws in your jurisdiction (including, but not limited to copyright laws).
10. You must not transmit any viruses, trojans, worms or any other code of a malicious nature.

Your Snockles.com account may be terminated if you are in violation of any of these agreements. While Snockles.com prohibits such content and conduct on its site, you understand and accept that Snockles cannot be held responsible for the Content that is posted by the users, and that you may be exposed to such material, and that you use the Snockles.com service at your own risk.

Conditions

1. We reserve the right to modify these Terms of Use at any time. If the modifications constitute a material change to the Terms of Use, we shall notify you through email according to your expressed preference on your account. What constitutes a "material change" will be ascertained at our sole discretion, using reasonable judgment and common sense, and in good faith.
2. We reserve the right to alter or terminate the Snockles.com service, without notice, at any time, for any reason.
3. We may, but are under no obligation to, delete Content and accounts which contain Content that we ascertain at our sole discretion to be obscene, threatening, unlawful, libelous, defamatory, offensive or otherwise objectionable, or violates any intellectual property or our Terms of Use.
4. We reserve the right to refuse service to anyone, at any time, for any reason.
5. We reserve the right to repossess user names on behalf of individuals or businesses that hold trademark or legal claim on those user names.

Copyright

1. We do not claim any intellectual property rights on the material you make available to the Snockles service. Your uploaded materials and profile remain yours. You can delete your profile whenever you want by removing your account. This will also delete any text and/ or images that you may have saved in the system.
2. Snockles promises to obey all pertinent copyright laws. We shall review all the claims of copyright infringement that we receive and delete content that are deemed to have been distributed or posted in violation of any copyright laws. In order to make a claim, kindly provide us with the following -
1. A detailed description of the copyrighted work claimed to have been infringed;
2. A detailed description of the infringing material and sufficient information to permit Snockles to locate the same;
3. An electronic or physical signature of the copyright owner, or of the person authorized to act on his/ her behalf;
4. Your statement that you believe that use of the material in the specified manner is not sanctioned by the copyright owner, his/ her agent, or the law;
5. Your contact information including your address, email, and telephone number; and
6. A statement to the effect that the information presented is accurate, and that you are authorized to act on behalf of the copyright owner.

Limitation of Liability

1. This Service is provided to you on an "as available" and "as is" basis. SNOCKLES DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS OR WARRANTIES (INCLUDING BUT NOT LIMITED TO RELIABILITY, MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT) REGARDING THE USE, OR THE RESULTS OF THE USE, OR THE CONTENTS OF THE SERVICE. You understand that the Service may not work with complete functionality, may be available inconsistently, may have software "bugs", may be undergoing testing, and may have other issues affecting functionality and availability. In addition to all limitations of liability and other disclaimers contained in these Terms of Use, you explicitly agree that Snockles is not accountable for any of the above issues. Furthermore, you understand that Snockles does not represent or warrant that the Service will be compatible with all mobile phone networks, will work on all mobile phones, and/ or will be available for use in all geographical areas.
2. SNOCKLES SHALL NOT BE ACCOUNTABLE FOR ANY DAMAGE OR LOSS, WHETHER DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL, ARISING OUT OF THE USE OF, OR THE INABILITY TO USE THE SERVICE, OR THE RESULTS OR THE CONTENTS THEREOF, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
3. If you are not satisfied with the Service, or have any other claims or disputes with or against Snockles with respect to the Service or these Terms of Use, then your only solution is to discontinue using the Service.

 

Alteration of Terms of Use

You recognize that we are constantly developing the functionality and the features of the Service. As a result, we also reserve the right to alter these Terms of Use at our sole discretion, at any time. You also agree that such modifications shall be effective upon posting on the Snockles.com web site, and you shall be bound to any modifications when you use the Service after such modifications are posted. Thus, it is important that you go over these Terms of Use on the Snockles.com web site on a regular basis to make sure that you are informed concerning any modifications. Your only solution, should you not agree with the modified Terms of Use, shall be to close your account and discontinue using the Service.
